2. Acceptance of These Terms

By accessing or using this website, submitting an enquiry, requesting a proposal or otherwise interacting with Totem through this website, you agree to use the website in accordance with these Terms & Conditions and applicable law.

If you engage Totem for paid services, the specific proposal, quotation, work order, agreement, scope of work, invoice or other written commercial document accepted by both parties will govern that engagement. Where there is any inconsistency between these website terms and an executed client agreement, the executed agreement will prevail for that engagement.

3. Website Information

We aim to keep information on this website accurate and current. However, service descriptions, prices, packages, examples, availability, timelines and other information may change from time to time.

Content on this website is provided for general business information and should not be treated as a binding commercial offer unless specifically confirmed by Totem in writing.

Read the Website Disclaimer for further context on the information and examples published on this website.

4. Enquiries, Proposals and Service Engagements

Submitting a contact form, booking a consultation or requesting a proposal does not by itself create a client-service relationship or obligate either party to proceed.

A service engagement begins only when the relevant scope, commercial terms and approvals have been agreed through an accepted proposal, agreement, work order, invoice or other written confirmation.

5. Scope, Deliverables and Timelines

The scope of work, deliverables, number of creatives, shoots, campaigns, advertisements, website pages, reports, revisions, platform services, timelines and responsibilities will be determined by the applicable written proposal or agreement.

Timelines may depend on timely receipt of client approvals, access credentials, content, brand material, product information, payments and other required inputs.

6. Client Responsibilities

Clients are responsible for providing accurate information, timely approvals and the permissions necessary for Totem to use any material supplied by them.

The client must ensure that logos, photographs, videos, testimonials, trademarks, product claims, medical or professional claims, offers, pricing and other materials supplied to Totem may lawfully be used for the intended purpose.

7. Payments and Taxes

Fees, payment schedules, taxes, advertising budgets, third-party costs and payment milestones are governed by the applicable proposal, agreement, invoice or work order.

Unless specifically included in writing, third-party expenses such as advertising spend, software subscriptions, hosting, domains, paid media, printing, travel, influencers, models, stock assets or platform charges may be billed separately or paid directly by the client.

8. Advertising and Third-Party Platforms

Services may involve third-party platforms such as Google, Meta, Instagram, Facebook, WhatsApp, YouTube, hosting providers, CRM platforms, payment providers and other technology services.

Such platforms operate under their own policies, algorithms, approval systems, availability and technical conditions. Totem does not control changes, suspensions, disapprovals, outages, account restrictions or algorithm updates imposed by third-party platforms.

9. Marketing Results

Marketing, advertising, SEO, GEO, social media, lead generation and other growth services involve variables outside Totem’s direct control.

Unless expressly guaranteed in a signed written agreement, Totem does not guarantee specific rankings, impressions, followers, leads, enquiries, sales, revenue, appointments, patient volumes, admissions or other commercial outcomes.

10. Intellectual Property

Each party retains ownership of intellectual property, trademarks, content, systems, templates, processes, know-how and materials owned by that party before the engagement.

Ownership or licensing of deliverables created specifically for a client will be governed by the applicable written agreement, proposal or work order, including any conditions relating to full payment, third-party licences or reusable Totem systems and templates.

11. Portfolio and Case Studies

Totem may display work, project descriptions, campaign examples or case studies only where it has a lawful basis or appropriate permission to do so.

Any performance figures displayed in case studies should be understood in the context stated on the relevant page and should not be interpreted as a guarantee of identical results for another business.
